2. Nature of a donation
A donation is a gratuitous contribution to the Foundation. It does not constitute payment for a product, service, membership, advertising, sponsorship or preferential treatment. Under Polish civil law, a performed monetary donation may be valid even if the donor's declaration was not made in the form of a notarial deed.
3. Purpose of donations
Unless the Foundation expressly offers and accepts a designated-purpose option, donations made through the general donation page are allocated to the Foundation's statutory purposes. These include human-rights protection, support for people in difficult circumstances, education, research, humanitarian activity, local-community development, social inclusion, work with children and young people, health promotion, culture and other statutory activities.
If a donor selects a specific project or purpose that the Foundation has expressly made available as a designated donation, the Foundation will use the donation consistently with that designation. If carrying out that purpose becomes impossible, the Foundation will act in accordance with the law, the conditions attached to the donation and, where reasonably possible, contact an identifiable donor before reallocating or returning funds.
4. Donation amount and currency
The donor chooses the amount from options displayed on the payment page or enters another permitted amount. The initial online donation flow is intended for PLN. Any minimum or maximum amount imposed by the payment provider will be shown in the checkout environment.
5. Payment processing
Online payments are intended to be processed through a secure hosted checkout operated by Stripe on an account belonging to the Foundation. The payment methods available to a donor depend on the provider, device, country, currency and risk controls. The donor must follow the instructions shown by the payment operator.
The Foundation receives information necessary to identify and record the donation but does not need to receive full payment-card details. The payment provider may independently process transaction and anti-fraud data under its own rules and legal obligations.
6. When the donation is made
The donation is completed when the payment is successfully authorised and the funds are made available to the Foundation in accordance with the payment provider's settlement process. A failed or abandoned checkout does not create an obligation to complete the donation.
7. Fees
The donor pays the amount displayed and confirmed in checkout. The payment operator may charge the Foundation transaction-processing fees or other fees under the Foundation's separate agreement with that provider. Such fees do not convert the donation into a purchase of services.
8. Mistaken, duplicate or unauthorised payments
A donor who believes that a payment was made by mistake, duplicated, made in an incorrect amount or made without authorisation should contact whiteredfoundation@gmail.com as soon as possible and provide enough information to identify the transaction. The Foundation will verify the request, payment-operator information and applicable law before deciding whether and how a return can be made.
9. Fraud, sanctions and legal compliance
The Foundation or payment operator may refuse, suspend, return or investigate a transaction where required by law, financial-security rules, sanctions, fraud-prevention controls or the payment provider's mandatory procedures. Additional information may be requested when legally justified.
10. Confirmation and tax matters
A payment confirmation may be generated by the payment operator. If the donor requires a separate written confirmation from the Foundation, the donor may contact the Foundation and provide the information needed to identify the payment.
Possible tax consequences or deductibility of donations depend on the donor's individual circumstances and applicable tax law. The website does not provide individual tax advice.
11. Personal data
Personal data relating to donations is processed for the performance and documentation of the donation, compliance with accounting and tax obligations, fraud prevention, legal claims and related communication. Further information is provided in the Privacy Policy.
12. Complaints
Questions or complaints about a donation may be sent to whiteredfoundation@gmail.com. The message should contain the date, amount and information sufficient to identify the payment, but should not include full card numbers or security codes.
13. Changes
The Foundation may update these terms when the payment operator, law or donation process changes. The version applicable to a donation is the version made available when the donation is initiated.
